About these terms
These Terms of Use ("Terms") govern your access to and use of the HARBOR TREE website at harbor-tree.vercel.app (the "Site"). By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
If we end up working together on a project, that work is governed by a separate written engagement agreement we'll sign with you. These Terms cover the website itself; the engagement agreement covers the project.
Who we are
HARBOR TREE is a website design and business automation studio based in Essex, Maryland. In these Terms, "we," "us," and "our" refer to HARBOR TREE.
Using the Site
You may use the Site to learn about our services, view our work, and contact us about a potential project. In using the Site, you agree not to:
- Submit false, misleading, or impersonating information through the contact form
- Attempt to gain unauthorized access to any part of the Site, our servers, or any related systems
- Upload or transmit malware, scripts, or other harmful code
- Scrape, crawl, or harvest content from the Site for use in training machine-learning models, building competing services, or commercial republication, without our prior written consent
- Use the Site to send unsolicited marketing, recruitment outreach, or spam to us
- Use the Site for any unlawful purpose or in any way that could damage, disable, or impair it
Intellectual property
All content on the Site — including the name "HARBOR TREE," the logo and wordmark, the writing, the design, the layout, the imagery, and the underlying code — is owned by HARBOR TREE or used under license. It is protected by copyright, trademark, and other intellectual-property laws.
You may view the Site and share links to it. You may not copy, reproduce, modify, distribute, sell, or create derivative works from any part of the Site without our prior written permission. Case-study work shown on the Site is published with our clients' permission and remains their intellectual property where applicable.
Project work is covered separately
Nothing on the Site is an offer to enter into a project, and submitting the contact form does not create a contract. We engage on projects only after a discovery call, a written proposal, and a signed engagement agreement. Pricing, scope, timelines, and deliverables described on the Site are illustrative; the binding terms are the ones in your engagement agreement.
Third-party links and services
The Site may link to third-party websites or services we don't operate (for example, our contact-form processor or font provider). We're not responsible for the content, policies, or practices of those third parties. Following an external link is at your own risk.
Disclaimer of warranties
The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied — including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that the Site will always be available, that information on it is current or complete, or that it is free of viruses or other harmful components.
Limitation of liability
To the fullest extent permitted by law, HARBOR TREE, its founder, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Site — including lost profits, lost data, or business interruption — even if we've been advised of the possibility of such damages.
Our total aggregate liability arising from or related to your use of the Site is limited to one hundred U.S. dollars ($100). Some jurisdictions don't allow these limitations, in which case the limitations apply to the maximum extent permitted by applicable law.
Indemnification
You agree to indemnify and hold harmless HARBOR TREE from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.
Privacy
Your use of the Site is also governed by our Privacy Policy, which explains what we collect and how we use it.
Governing law
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Baltimore County, Maryland, and you consent to the personal jurisdiction of those courts.
Changes
We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top. Material changes will be reflected on the Site. Continued use of the Site after changes are posted means you accept the updated Terms.
